29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).  On or about October 5, 2022, and at times prior thereto, at the residential construction site, the employer did not ensure employees wore fall protection while installing shingles on the roof of the home at six (6) feet or more above the lower levels, exposing employees to fall hazards.   a.	An employee was exposed at approximately 22.7 feet while working on the roof in front of the home without fall protection. b.	An employee was exposed at approximately 11.9 feet while working on the roof in front of the home without fall protection. c.	Two employee was exposed at approximately 9.5 feet while working on the roof in the front of the home without fall protection.  Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1475648, citation number 001, item number 002, issued on June 5, 2020, and was affirmed as a final order on July 7, 2020, with respect to a workplace located at 6613 Barnes Road, Frisco, TX 75034.  Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1562106, citation number 002, item number 001, issued on November 12, 2021, and was affirmed as a final order on December 6, 2021, with respect to a workplace located at 5108 Holy Springs Road, Denton, TX 76207.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and steps were not parallel, level, and uniformly spaced when the ladder was in position for use.  On or about October 5, 2022, and at times prior thereto, at the residential construction site, the employer did not ensure the ladders being used by employees to access an upper surface had the cleats placed properly and parallel to the ground, exposing employees to fall hazards.    a. Employees were exposed to fall hazards when using the extension ladder placed at the front door entrance of the home.   b. Employees were exposed to fall hazards when using another extension ladder placed next to the front door entrance of the home.   Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1052(a)(2), which was contained in OSHA inspection number 1562106, citation number 001, item number 001, group a, issued on November 12, 2021, and was affirmed as a final order on December 6, 2021, with respect to a workplace located at 5108 Holy Springs Road, Denton, TX 76207.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about October 5, 2022, and at times prior thereto, at the residential construction site, the employer did not ensure employees were using the ladder side rails extended at least three (3) feet above the upper landing surface to access the roof, exposing employees to fall hazards.  a. Employees were exposed to fall hazards when using the extension ladder placed next to the front door entrance of the home.   b. Employees were exposed to fall hazards when using another extension ladder placed in the back yard of the home.  Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1475648, citation number 001, item number 003, issued on June 5, 2020, and was affirmed as a final order on July 7, 2020, with respect to a workplace located at 6613 Barnes Road, Frisco, TX 75034.
