OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed by hazards:  (a)ABC Supply Company, Inc. at 4815 North Cliff Avenue, Sioux Falls, SD 57104: On or about and at times prior to November 22, 2021, employees were exposed to crushing hazards in that commercial pallet racking located on the west side exterior of the main building warehouse had a damaged leg and was being used to store merchandise. This condition exposed employees to struck-by and crushing hazards.  (b)ABC Supply Company, Inc. at 4815 North Cliff Avenue, Sioux Falls, SD 57104: On or about and at times prior to November 22, 2021, employees were exposed to crushing hazards in that commercial pallet racking located on the north wall of the main building warehouse had multiple bent crossmember support beams and was being used to store merchandise. This condition exposed employees to struck-by and crushing hazards.  (c) ABC Supply Company, Inc. at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, employees were exposed to struck-by and crushing hazards when walking in and around the work area.  Pallet storage racks located inside the main warehouse and throughout the northwest warehouse were freestanding and inadequately bolted. This condition exposed employees to struck-by and crushing hazards.   Abatement Note:  Among other methods, one feasible and acceptable abatement methods to correct this hazard are to follow American National Standard Institute (ANSI) and Rack Manufacturers Institute (RMI)-ANSI-RMI MH 16:1-2012, "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks."   Under paragraph 1.4.1 Owner Maintenance, (2)"Regularly inspect for damage. If damage is found, immediately isolate the affected area. Have a storage rack design professional evaluate the damage and unload, replace or repair if directed by the professional, any damaged columns, beams, or other structural component to restore the system to at least its original design capacity." Additionally, under paragraph 1.4.9 Rack Damage, "Upon any visible damage, the pertinent portions of the rack shall be immediately isolated by the user until the damaged portion is evaluated by a storage rack design professional. Before allowing the rack to be placed into service the design professional must certify that the rack system and/or the repaired components have been restored to at least their original design capacity.

29 CFR  1910.22(a)(1): All places of employment, passageways, storerooms, service rooms, and walking-working surfaces were not kept in a clean, orderly, and sanitary condition:   (a)ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure the warehouses and the outside storage areas were kept clean and orderly in that equipment, tools, chemical containers, dunnage along with other waste materials were found scattered on the ground throughout the facilities where employees walked and operated powered industrial trucks.  This condition exposed employees to fall and tripping  hazards.

29 CFR  1910.23(b)(10): The employer did not ensure any ladder with structural or other defects was immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with 1910.145 and removed from service until repaired in accordance with 1910.22(d), or replaced:  (a) ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure a damaged mobile ladder stand located in the south yard was removed from service or repaired by a qualified technician.  This condition exposed employees to fall hazards greater than four feet due to potential structural failure on mobile ladder systems.  (b) ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure a damaged mobile ladder stand located in the northwest warehouse was removed from service or repaired by a qualified technician.  This condition exposed employees to fall hazards greater than four feet due to potential structural failure on mobile ladder systems.

29 CFR  1910.303(b)(7)(i):Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment:  (a) ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure that electrical equipment was effectively closed, in that employees are exposed to live electrical circuits associated with two open electrical junction boxes on the north mezzanine in the main warehouse .  This condition exposed employees to shock and electrocution as well as fire hazards associated with exposed wiring on the electrical boxes.  (b) ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure that electrical equipment was effectively closed, in that employees are exposed to live electrical circuits associated with one electrical junction box on the west wall of the northeast warehouse. This condition exposed employees to shock and electrocution as well as fire hazards associated with exposed wiring within the electrical box.

29 CFR  1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure:  (a) ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure the electrical extension cord being utilized on the south wall of the main building warehouse was not used by employees as permanent wiring for the sheet metal coiling machine located under the south mezzanine.  This condition exposed employees to electrical shock hazards associated with improper use of electrical equipment.

29 CFR  1910.334(a)(3)(i): A flexible cord used with grounding type equipment did not contain an equipment grounding conductor:   (a) ABC Supply Company, Inc at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 22, 2021, the employer did not ensure the electrical cord connected to the sump pump used to remove water from the trailer loading pit located in the southwest corner of the yard site was properly inspected for a serviceable ground plug.  The ground plug was broke off and missing from this cord.  This condition exposed employees to electrical hazards associated with using electricity in close proximity to a water source.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section:   (a)ABC Supply Company, Inc. at 4815 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to November 21, 2021, employees were exposed to chemical hazards in that hazardous chemicals in the workplace were not labeled. Two containers, a blue barrel mistakenly thought to contain Def for diesel trucks and a clear jug filled with dark fluid were not labeled. This condition exposed employees to injuries with improper use of chemicals.
