29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about November 23, 2021, and at times prior thereto, at residential construction, the employer did not ensure employees were wearing safety glasses while installing shingles using pneumatic nail guns, exposing employees to eye and face injuries.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  On or about November 23, 2021, and at times prior thereto, at residential construction, the employer did not ensure employees were wearing fall protection while installing shingles at approximately nine (9) feet above the ground, exposing employees to fall hazards.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.)  On or about November 23, 2021, and at times prior thereto, at residential construction, the employer did not ensure employees were using the ladder side rails extended at least three (3) feet above the upper landing surface to access the roof, exposing employees to fall hazards.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  On or about November 23, 2021, and at times prior thereto, at residential construction, the employer did not ensure employees installing roof shingles were trained to recognize and avoid slip and fall hazards related to ladders.
