OSH ACT of 1970 Section (5)(a)(1): Employees were exposed to damaged and leaning warehouse racks that were not anchored to the floor: (a) On or about November 16, 2021, in the warehouse at Plaza Extra East, employees engaged in warehousing work were exposed to struck-by and crush-by hazards. The employer did not ensure that the foot plates of the metal pallet racks were anchored to the floors by fastener bolts, rack columns and beams were bent and damaged, and out of plumb and straight allowances. Among other methods, feasible and acceptable methods to correct theses hazardous conditions would be: 1. Adhere to the recommendations in accordance with Consensus Standard ANSI MH16.1-2012, Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks: - Section 1.4.1, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational, housekeeping, and maintenance procedures including, but not limited to, regularly inspecting for damage." - Section 1.4.9, "Upon visible damage, the pertinent portions of the rack shall be immediately isolated by the user until the damaged portion is evaluated by a storage rack design professional." - Section 1.4.7, "All rack columns shall be anchored to the floor with anchor bolts." - Section 1.4.11, "Out-of-plumb and Out-of-straight limits should be unloaded and replumbed, and any damaged parts must be repaired or replaced."
