29 CFR 1926.453(a)(2): Aerial lifts were "field modified" for uses other than those intended by the manufacturer, the modification had not been certified in writing by the manufacturer, or by any other equivalent entity, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification: a) Danny Miller dba D&A Roofing, 953 East 12th Street. Erie, PA. On or about December 1, 2021, employees are using a Genie aerial lift that was field modified for uses other than those intended by the manufacturer. Modifications included an extended platform, made from boards, that was used to lift metal roofing sheets and other tools and equipment onto the roof. This ongoing violation was most recently observed on December 1, 2021. To abate this ongoing violation, written certification must be obtained from the manufacturer stating that the lift modification does not affect equipment safety.

On or about December 1, 2021, employees are installing a metal roof on the industrial building, with a 6:12 pitch, 30 feet above the ground. Fall protection is not being utilized by employees when conducting work on the roof. This ongoing violation was most recently observed on December 1, 2021. To abate this ongoing violation, the employer must enforce the use of fall protection when employees are working on the roof. Danny Miller dba D&A Roofing was previously cited for a Willful Violation of this occupational safety and health standard, or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1543945, citation number 1, item number 1 and was affirmed as a final order on October 27, 2021, with respect to a worksite located at 1311 East Ave., Erie, PA 16507. In addition, Danny Miller dba D&A Roofing was previously cited for a Willful Violation of this occupational safety and health standard, or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1471227, citation number 1, item number 1B and was affirmed as a final order on March 27, 2020, with respect to a worksite located at 201 W 26th St., Erie, PA 16508.
