29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) D & N Construction LLC at 6705 East Roddel Circle, Sioux Falls, SD 57110:  On or about and at times prior to December 2, 2021, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards as a result of conducting roofing activities on the residential home without the use of a fall protection system, fall hazards associated with improper use of ladders, and lack of training. This condition exposed employees to a variety of hazards identified on site.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)D & N Construction LLC at  6705 East Roddel Circle, Sioux Falls, SD 57110:  On or about and at times prior to December 2, 2021, the exposing employer did not ensure that employees were trained in the use of fall protection systems or hazards of working from heights prior to conducting roofing activities on a residential property.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)D & N Construction LLC at  6705 East Roddel Circle, Sioux Falls, SD 57110:  On or about and at times prior to December 2, 2021, the exposing employer did not ensure that the ladder being used for access onto the residential property roof was extended at least three feet above the upper landing surface.  This condition exposed employee to fall hazards associated with ladder access.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)D & N Construction LLC at  6705 East Roddel Circle, Sioux Falls, SD 57110:  On or about and at times prior to December 2, 2021, the exposing employer did not ensure that employees were protected from fall hazards while conducting roofing activities on a residential property.  This condition exposed employees to fall hazards greater than six feet.  D & N Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1539339, citation number 1, item number 1, and was affirmed as a final order on September 2, 2021, with respect to a workplace located at 424 West 5th Street, Crooks, SD 57020.
