29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. The employer failed to provide abatement documentation supporting that the fall hazard related to citation number 1-1 and required fall hazard safety training related to citation 1-2, which were issued on February 25, 2022, were abated.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about December 2, 2021 at a construction site located at 4700 Co Rd DD in Wrightstown, Wisconsin, employees were exposed to fall hazards eighteen feet above surface level while installing metal roof decking without utilizing fall protection equipment during construction of a pole building. The J & W Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.761(a)(1), which was contained in OSHA inspection number 1407000, citation number 01, item number 01b and was affirmed as a final order on October 15, 2019 with respect to a workplace located at Camber Ct and Packerland Dr., Hobart, WI 54115.

29 CFR 1926.761(b): Steel Erection. Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. On or about December 2, 2021 at a construction site located at 4700 Co Rd DD in Wrightstown, Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than 15 feet while installing metal roof decking during construction of a pole building. The J & W Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.761(b), which was contained in OSHA inspection number 1407000, citation number 02, item number 001 and was affirmed as a final order on October 15, 2019 with respect to a workplace located at Camber Ct and Packerland Dr., Hobart, WI 54115.
