29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. On or about December 3, 2021, and at times prior thereto, on the roof of a newly constructed commercial building, employees were exposed to a fall hazard exceeding six feet when performing roofing work without a fall protection system.

29 CFR 1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: On or about December 3, 2021, at a construction site on Highway 105 in Conroe, TX, an employee was working from a Genie S-65 aerial performing roofing activities with sheet metal, without a personal fall arrest system or lanyard attached to the boom or basket of the lift. A & P CONSTRUCTION AND STEEL ERECTORS, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.453(B)(2)(V), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1323030, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 4, 2018, WITH A FINAL ABATEMENT DATE OF JUNE 13, 2018, WITH RESPECT TO A WORKPLACE LOCATED AT 1150 MCCALEB RD., MAGNOLIA, TEXAS 77354.
