29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   a) Kanta Products Inc., Three Forks, MT: On or about January 12th, 2022 and at times prior , employees were exposed to high levels of noise while working in and around the Block Manufacturing Warehouse. Employee noise levels were measured at 88 decibels on an A-weighted scale (dBA) for a sampling period of 452 minutes which is calculated to be dose of 75.6% of the action level (8-hour time-weighted average action level of 85 dBA). The employer failed to implement an effective hearing conservation program when employee exposure was above the action level.  b) Kanta Products Inc., Three Forks, MT: On or about January 12th, 2022 and at times prior , employees were exposed to high levels of noise while working in and around the Block Manufacturing Warehouse. Employee noise levels were measured at 87.8 decibels on an A-weighted scale (dBA) for a sampling period of 449 minutes which is calculated to be dose of 74.0% of the action level (8-hour time-weighted average action level of 85 dBA). The employer failed to implement an effective hearing conservation program when employee exposure was above the action level.
