29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   a) Kanta Products Inc., Three Forks, MT: On or about January 12th, 2022 and at times prior , employees were exposed to high levels of noise while working in and around the Block Manufacturing Warehouse. Employee noise levels were measured at 88 decibels on an A-weighted scale (dBA) for a sampling period of 452 minutes which is calculated to be dose of 75.6% of the action level (8-hour time-weighted average action level of 85 dBA). The employer failed to implement an effective hearing conservation program when employee exposure was above the action level.  b) Kanta Products Inc., Three Forks, MT: On or about January 12th, 2022 and at times prior , employees were exposed to high levels of noise while working in and around the Block Manufacturing Warehouse. Employee noise levels were measured at 87.8 decibels on an A-weighted scale (dBA) for a sampling period of 449 minutes which is calculated to be dose of 74.0% of the action level (8-hour time-weighted average action level of 85 dBA). The employer failed to implement an effective hearing conservation program when employee exposure was above the action level.

29 CFR  1910.1200(f)(6)(ii):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical   a) Kanta Products Inc., south wall of maintenance shop: On or about November 29, 2021 and at time prior employee were exposed to chemical hazards while working with chemicals such as, but not limited to: ethylene glycol (Antifreeze). The employer failed to ensure that each container of chemicals in the workplace was labeled with the product identifier in words, pictures, symbols, or combination thereof, which provides at least general information regarding the hazards of the chemicals.
