29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)	Patriot Petroleum Solutions, LLC at 7602 S. College Ave., Fort Collins, CO 80525:  On and before December 3, 2021, the creating and exposing employer did not ensure daily inspections of the excavation were made by a competent person for evidence of a situation that could have resulted in excavation cave-in or equipment falling and/or rolling into the excavation.  An employee excavating a trench, which was approximately 10 feet wide, 20 feet in length, and ranged from 12 feet to 16 feet in depth, operated an excavator inside the trench without the use of a protective system.  Hazards included two nearly vertical walls and a John Deere 210 excavator positioned within 2 feet of an edge.  This condition exposed the employee to cave-in and struck-by hazards.

29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure were undermined and a support system or another method of protection was not provided to protect employees from the possible collapse of such structures:  (a)	Patriot Petroleum Solutions, LLC at 7602 S. College Ave., Fort Collins, CO 80525:  On and before December 3, 2021, the creating and exposing employer did not ensure that undermined pavement at the excavation's top edge had a support system or another method of protection provided to protect employees from the possible collapse of such structures. This condition exposed employees to struck-by hazards associated with material falling into the excavation.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a)	Patriot Petroleum Solutions, LLC at 7602 S. College Ave., Fort Collins, CO 80525:  On and before December 3, 2021, the creating and exposing employer did not ensure that heavy equipment was at least 2 feet from the edge of the trench in that a John Deere 210G excavator was positioned approximately 1.5 feet from the edge and directly above an employee working below.  This condition exposed employees to excavation wall cave-in hazards and struck-by hazards associated with equipment falling into the excavation.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):   (a)	Patriot Petroleum Solutions, LLC at 7602 S. College Ave., Fort Collins, CO 80525:  On and before December 3, 2021, the creating and exposing employer did not ensure that each employee conducting work in an excavation was protected from cave-in, in that an employee excavating a trench, which was approximately 10 feet wide, 20 feet in length, and ranged from 12 feet to 16 feet in depth, operated an excavator inside the trench without the use of a protective system.  Hazards included two nearly vertical walls and a John Deere 210 excavator positioned within 2 feet of an edge.  This condition exposed the employee to cave-in and struck-by hazards.
