29 CFR  1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a) On or about March 19, 2026, and at times prior, employees of Patriot Petroleum Solutions were exposed to cave-in hazards while placing underground storage tanks and related structures in an unprotected excavation in excess of 5 feet in depth. The south wall of the excavation was at least 6.5 feet in height, and there were signs of sloughing. Employees worked within the shadow of the wall to help place and strap down two underground storage tanks; no protective measures or systems were utilized.  Patriot Petroleum Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.651(k)(1)), which was contained in OSHA inspection number 1567099, citation number 1, item number 3, and was affirmed as a final order on June 28, 2022, with respect to a workplace located at 7602 S. College Ave. Fort Collins, CO 80525.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a) On or about March 19, 2026, and at times prior, the employer did not ensure daily inspections of the excavation were made by a competent person for evidence of a situation that could have resulted in excavation cave-in(s). Employees were installing underground storage tanks and related structures in the bottom of an excavation. Employees were working in the excavation, which was greater than 5 feet in depth, without the use of a protective system.  Employees were working within the shadow of the south vertical wall during one of the tank placements.  Hazards included two nearly vertical walls, fissures, and sloughing. This condition exposed employees to cave-in and struck-by hazards.  Patriot Petroleum Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.651(k)(1)), which was contained in OSHA inspection number 1567099, citation number 1, item number 1, and was affirmed as a final order on June 28, 2022, with respect to a workplace located at 7602 S. College Ave. Fort Collins, CO 80525.
