29 CFR 1926.1153(c)(1):Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. (a) At a jobsite located near Cold Water Lane and Alexander Creek Drive in Raymore, MO; an employee was exposed to respirable crystalline silica when operating a hand held power saw while a section of concrete and asphalt on the road. The hand held power saw was operated for under 4 hours a shift without an integrated water delivery system that continuously feeds water to the blade. The operation was creating large amounts of visible dust that was in the breathing zone of the operator. This was documented on or about 7 Dec 2021.

29 CFR 1926.1153(d)(1):The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 g/m3, calculated as an 8-hour TWA: (a) At a jobsite located near Cold Water Lane and Alexander Creek Drive in Raymore, MO; an employee was exposed to respirable crystalline silica when operating a hand held power saw while a section of concrete and asphalt on the road. The operation was creating large amounts of visible dust that was in the breathing zone of the operator. The employer did not provide air sampling data for operating a hand held power saw. This was documented on or about 7 Dec 2021.
