29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: At a worksite located at or near the intersection of E Main Street and S. Sycamore Street, Branson, MO 65616: Employees were exposed to struck-by, engulfment, and drowning hazards when entering a flooded excavation for the purposes of rescue. This was demonstrated on or about August 21, 2025, when employees were performing work inside an excavation that experienced rapid flooding due to the release from a high pressure water line. The employer failed to instructed each such employee to recognize the hazards inherent in rescue efforts and the associated risks to potential rescuers not trained in or properly equipped for rescue operations.
