29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part.  On or about December 7, 2021 the employer Randy J. Smith Construction & Roofing, LLC at worksite located at 5671 Commodore Dr. Port Clinton OH 43452, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

Smith Construction & Roofing, LLC at worksite located at 5671 Commodore Dr. Port Clinton OH 43452, did not ensure employees were protected from falls while using job-made construction lumber ladders, which did not contain rungs, cleats and steps which are parallel, level and uniformly spaced when the ladder is in the position of use.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about December 7, 2021 the employer Randy J. Smith Construction & Roofing, LLC at worksite located at 5671 Commodore Dr. Port Clinton OH 43452, did not ensure employees were protected from falls while conducting residential construction activities on the second level of a new build stick frame residential garage, while exposed to a fall of 10 feet 4 inches to the ground below.  Randy J. Smith Construction & Roofing, LLC was previously cited for a violation of an equivalent occupational safety and health standard 1926.501(b)(1), which was contained in OSHA inspection number 1462476, citation number one, item number two and was affirmed as a final order on 03/24/2020, with respect to a workplace located at 3495 NW Catawba Rd. Port Clinton OH 43452.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about December 7, 2021 the employer Randy J. Smith Construction & Roofing, LLC at worksite located at 5671 Commodore Dr. Port Clinton OH 43452, did not ensure the side rails of two construction lumber job-made ladders were extended at least three feet above the landing surface. Three employees were exposed to falls of 10 feet 4 inches while using the ladders to access and work on the second level of the residential garage.  Randy J. Smith Construction & Roofing, LLC was previously cited for a violation of this occupational safety and health standard 1926.1053(b)(1), which was contained in OSHA inspection number 1462476, citation number one, item number three and was affirmed as a final order on 03/24/2020 , with respect to a workplace located at 3495 NW Catawba Rd. Port Clinton OH 43452.
