29 CFR 1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part. Isma Construction Service, LLC at the worksite located at 843 N. Summit in Toledo, Ohio: On or about December 9, 2021, the employer did not implement a plan or safety program to identify job site hazards for employees to maintain a safe working environment. Such a program would allow the employer to identify potential hazards such as falls during job site operations, decreasing the probability of employee injury. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Isma Construction Service, LLC at the worksite located at 843 N. Summit in Toledo, Ohio: On or about December 9, 2021, the employer did not ensure employees were trained to recognize appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems. Employees performing framing activities on a commercial structure were exposed to fall hazards of up to approximately 25 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Isma Construction Service, LLC at the worksite located at 843 N. Summit in Toledo, Ohio: On or about December 9, 2021, the employer did not ensure employees who were installing ceiling joists were protected from falls. Employees were exposed to falls hazards of approximately 13 feet to the interior of the structure and up to approximately 25 feet from the exterior roof edge to the ground below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Summit in Toledo, Ohio: On or about December 9, 2021, employees were exposed to fall hazards of up to approximately 12 feet in that open sided edges of a stairway located on the second floor, in the north corner of the structure, were not equipped with a guardrail system. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
