29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    On or about May 7, 2024 the employer ISMA Construction Service, LLC at jobsite located at 5625 Enterprise Blvd. Toledo OH 43612, did not ensure when scaffold platforms more than two feet above or below a point of access were being used, that portable ladders, hook-on ladders, attachable ladders were provided for employees to access the scaffold. Employees were exposed to falls in that cross braces and the frame of the tubular Biljax scaffold were being used as a means of scaffold access.

On or about May 7, 2024 the employer ISMA Construction Service, LLC at jobsite located at 5625 Enterprise Blvd. Toledo OH 43612, did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards, resulting in employee exposure to potential falls from the scaffold.

Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.    ISMA Construction Service, LLC was previously cited for a violation of this Occupational Safety and Health Standard CFR 1926.20(b)(1), which was contained in OSHA inspection number 1567658, citation number one, item number one-A and was affirmed as a final order on April 22, 2022, with respect to a workplace located at 843 N. Summit St., Toledo, OH 43604.

Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury or illness.    ISMA Construction Service, LLC was previously cited for a violation of this Occupational Safety and Health Standard CFR 1926.503(a)(1), which was contained in OSHA inspection number 1567658, citation number one, item number one-B and was affirmed as a final order on April 22, 2022, with respect to a workplace located at 843 N. 29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety nets:  On or about May 7, 2024 the employer ISMA Construction Service, LLC at jobsite located at 5625 Enterprise Blvd. Toledo OH 43612, did not ensure employees were protected from falls while performing roofing activities atop a low sloped commercial structure. Three employees roofing and making flat roof repairs on the commercial structure were exposed to a falls of 15 feet and 10 inches or greater to the ground below. The roof was a 2:12 pitch.  ISMA Construction Service, LLC was previously cited for an equivalent violation of this Occupational Safety and Health Standard CFR 1926.501(b)(1), which was contained in OSHA inspection number 1567658, citation number one, item number two and was affirmed as a final order on April 22, 2022, with respect to a workplace located at 843 N. Summit St., Toledo, OH 43604.
