29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) Battery Charging Area - On or about December 7, 2021, employees charged batteries for powered industrial vehicles and as needed, removed battery caps, adding distilled water to the battery unit. A suitable means for quick drenching and flushing of the eyes or body was not available in the immediate area, exposing employees to caustic battery acid. b) Chemical Storage Area - On or about December 7, 2021, employees stored and used chemicals in the stockroom to include but not limited to engine oil, steel polish, and simple green. An emergency eye/face wash manufactured by Honeywell was placed in the area for employee use, but the bottled solution was past the expiration date of January 1, 2021 and was not suitable for use, exposing employees to eye trauma hazards.

29 CFR 1910.1200(f)(6): The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5): a) Front of Store - On or about December 7, 2021, employees transferred Virex TB manufactured by Diversey, into spray bottles for application onto store carts for sanitation. The spray bottles used were not labeled with the information required to include but not limited to; product identifier and words, pictures, symbols or a combination thereof to provide general information regarding the hazards of the chemicals.
