29 CFR  1910.1200(e)(1):This standard is applicable to construction employment as defined by 1926.59.  The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200 paragraphs (f), (g), and (h) for labels and other forms of warning, safety data sheets, and employee information and training would be met.  The employer is failing to protect employees from the hazards associated with exposure to chemicals. This was most recently documented on or about December 14, 2021 at a residential construction jobsite located at 8202 S 194th St., Gretna Nebraska. The employer is failing to ensure that a written hazard communication program has been implemented in the workplace that specifies the chemicals utilized by the employees and their associated hazards.  Chemicals in use such as, but not limited to,  DYNAGRIP 4000 Subfloor Construction Adhesive.

The employer did not ensure that safety data sheets were readily accessible to the employees in their work area during each shift for chemicals used:  The employer is failing to protect employees from chemical exposure hazards while performing job related duties at the construction worksite. This was most recently documented on or about December 14, 2021 at a residential construction jobsite located at 8202 S 194th St., Gretna Nebraska. The employer is not ensuring that all employees are aware of Safety Data Sheets. In the event of accidental exposure, first aid may not be able to be determined or it may be delayed without the availability of SDSs.  Chemical in use such as, but not limited to,  DYNAGRIP 4000 Subfloor Construction Adhesive.

The employer is failing to ensure that each employee is trained to recognize the hazards associated with the chemicals utilized and encountered in the construction jobsite. This was most recently documented on or about December 14, 2021 at a residential construction jobsite located at 8202 S 194th St., Gretna Nebraska. The exposed employees were applying plywood on the residential structure at heights over 6 feet and not utilizing any form of fall protection.

The employer is failing to protect employees from fall hazards associated with using ladders during residential construction work. This was most recently documented on December 14, 2021 at 8202 S 194th St., Gretna Nebraska. A 10 foot-self supporting ladder used by employees did not have the metal spreader or locking device engaged while being used.

29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed:  The employer is failing to protect employees from fall hazards associated with using ladders during residential construction work. This was most recently documented on December 14, 2021 at 8202 S 194th St., Gretna Nebraska. A 10 foot-self supporting ladder was not used in the manner indicated by the manufacturer. Employees were using a self-supporting ladder as a non-self-supporting ladder when they leaned it against the residential structure and climbed it to access the upper level.
