29 CFR 1926.760(a)(1):Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. On or about December 15, 2021 at the 128 West Street Construction Project, an employee was working from the roof deck of the new dock installing the metal trim molding system and no fall protection system was in use. The employee was exposed to 18 and 19 foot falls.

29 CFR 1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. On or about December 15, 2021 at the 128 West Street Construction Project, an employee was in an aerial lift accessing and descending to and from the roof deck of the new dock and no personal fall protection system was in use. Gary Morin Erectors, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1307355, citation number 01, item number 001 and was affirmed as a final order on June 21, 2018, with respect to a workplace located at 42 Village Road in Ellington, CT.
