29 CFR  1926.1053(a)(14): The minimum perpendicular clearance between the center line of fixed ladder rungs, cleats, and steps, and any obstruction on the climbing side of the ladder shall be 30 inches (76 cm), except as provided in paragraph (a)(15) of this section.  a.  Located at 1799 Woodland Drive, Delaware, Ohio: On or about December 15, 2021, and at times prior, a portable ladder that was used on the left side of the roof to access the upper landing surface of the roof was obstructed and did not have the minimum clearance. As a result, employees were exposed to a fall hazard of up to 12 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.  The most recently occurred on or about December 15, 2021, at the job site located at 1799 Woodland Drive, Delaware, Ohio. The employer failed to ensure that employees who were performing roofing work on an existing residential structure were protected from fall hazards, thereby exposing them to an approximately twelve-foot fall hazard.  A & H Roofing Services, LLC. was previously cited for Serious and Repeat-Serious violations of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection numbers:  1) 1520996, Citation number 1 - Item number 4, Issued on 04/06/2021. 2) 1479491, Citation number 1 - Item number 3, Issued on 06/29/2020. 3) 1458624, Citation number 1 - Item number 4, Issued on 03/03/2020.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at 1799 Woodland Drive, Delaware, Ohio: On or about December 15, 2021, and at times prior, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize the hazards associated with roofing work. Employees were observed installing shingles with pneumatic nail guns on a roof and were not utilizing fall protection measures or eye protection measures. Additionally employees were not utilizing properly configured ladders. As a result, employees were exposed to struck-by and fall hazards of up to twelve feet. 29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a.
