29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about December 13, 2021, at the above addressed jobsite, a safe means of access was not provided to employees working in a trench performing piping installation for a new development. The trench, which measured approximately five (5) feet, six (6) inches to five (5) feet, nine (9) inches in depth, three (3) feet, six (6) inches in width and over 30 feet in length, had no ladder placed in the excavation, thereby exposing employees to cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about December 13, 2021, employees performing piping installation for a new development were exposed to cave-in hazards when working in a trench measuring approximately five (5) feet, six (6) inches to five (5) feet, nine (9) inches in depth, three (3) feet, six (6) inches in width and over 30 feet in length, when the employer did not ensure employees were protected by a protective system. HMD Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 1449159, citation number 1, item number 1 and was affirmed as a final order on February 22, 2020, with respect to a workplace located at 1342 Hawk Hollow Drive, Yorkville, IL. 60560.
