29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The employer is failing to protect employees from eye injuries associated with operating pneumatic nail guns and power tools. This was most recently documented on or about December 28, 2021 at a residential construction jobsite located at 6015 N 181st St., Elkhorn Nebraska. An employee was operating a pneumatic nail gun while engaged in residential roofing activities without the use of eye protection. Rios Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1548540, citation number 1, item number 3 and was affirmed as a final order on October 13, 2021, with respect to a workplace located at 16615 Read Street, Bennington NE.
