29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  a)  Foundry east side pit; On or about December 28, 2021 and at times prior,  the employer exposed employees to fall hazards in that employees were allowed to walk and work on open sided pit 4'11" above the next level that had open access that did not have a  standard guardrail, safety net systems, or personal fall arrest systems in place.  b)  Foundry shaker equipment control platform; On or about December 28, 2021 and at times prior,  the employer exposed employees to fall hazards in that employees were allowed to walk and work on a platform 6 feet above the next level that did not have a  standard guardrail (with top rail), safety net systems, or personal fall arrest systems in place.  c)  Foundry shaker equipment/ conveyor system; On or about December 28, 2021 and at times prior,  the employer exposed employees to fall hazards in that employees were allowed to walk and work on the reclaim equipment and conveyer with fall hazards of up to 12' 4" above the next level (pit around the reclaim equipment) that did not have a  standard guardrail, safety net systems, or personal fall arrest systems in place.

29 CFR 1910.28(b)(11)(ii): The employer did not ensure that each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as described in 29 CFR 1910.28 Table D-2-Stairway Handrail Requirements.  a)  Foundry east side pit; On or about December 28, 2021 and at times prior,  the employer exposed employees to fall hazards in that employees were allowed to use stairs with 7 treads and 8 risers that did not have a stair rail systems and handrails when accessing a 4.8 feet deep pit.

29 CFR 1910.1053(c): The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA:  (a) Reclaim area: On or about February 2, 2022, and at times prior thereto; the employer exposed an employee to respiratory hazards from respirable crystalline silica of 110 micrograms per cubic meter of air 8 hour TWA (time weighted average) while working at the sand reclaim area. Sampling occurred during  454-minute period with zero value for the 26 minutes not sampled.
