29 CFR  1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:   a) Cleaning room; On or about February 8, 2024, the employer did not make audiometric testing available for an employee working as a grinder who was exposed to continuous noise at a level of 295.4% (equivalent to an 8-hour TWA of 97.8 dBa) which is approximately 5.91 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBa). Results were calculated based on a 473-minute sampling period out of 480 assuming a zero increment for the 7 minutes not sampled.   b) Cleaning room; On or about February 8, 2024, the employer did not make audiometric testing available for an employee working as a grinder who was exposed to continuous noise at a level of 125.4% (equivalent to an 8-hour TWA of 91.7 dBa) which is approximately 2.54 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBa). Results were calculated based on a 472-minute sampling period out of 480 assuming a zero increment for the 8 minutes not sampled.  c) Cleaning room; On or about February 8, 2024, the employer did not make audiometric testing available for an employee working as a welder who was exposed to continuous noise at a level of 144.3% (equivalent to an 8-hour TWA of 92.8 dBa) which is approximately 2.96 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBa). Results were calculated based on a 465 minutes sampling period out of 480 assuming a zero increment for the 15 minutes not sampled.
