OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about 1/5/2022 at a residential construction site located at 5674 Glen Brook Court, Clarence, New York; employees were roofing an addition to a house from a job built work platform (pallet) attached to the forks of a rough terrain forklift. The use of a personnel platform was not approved for use by the forklift manufacturer, exposing employees to a fall hazards. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 1/5/22 at a roof project located at 5674 Glen Brook Court, Clarence, New York; employees were placing shingles on the roof of a two story addition. The roof had a 7 in 12 pitch and an eave height of approximately 20 feet. There was no fall protection in use. NO ABATEMENT CERTIFICATION REQUIRED
