29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) 635 NJ-33 Business, Freehold NJ:  The employer provided and required the worksite Foreman and three laborers to wear N95 respirators while using portable electric grinders to grind cement grout from between the exterior bricks of  a commercial building. The employer did not develop and implement a written respiratory protection program.  Violation occurred on, about, and before 01/06/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) 635 NJ-33 Business, Freehold NJ:  The employer did not provide medical evaluations for employees, including the worksite Foreman and three laborers, to determine if they were medically fit  to wear N95 respirators.  These employees were using portable electric grinders to grind cement grout out from between the exterior bricks of  a commercial building. The employer provided and required the employees to wear N95 respirators while performing the above activities at the worksite.  Violation occurred on, about, and before 01/06/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

These employees were using portable electric grinders to grind cement grout out from between the exterior bricks of  a commercial building.
