29 CFR  1926.1053(b)(4):  Ladders shall be used only for the purpose for which they were designed.  a.  On or about January 12, 2022, the employer did not ensure that an employee used the step ladder for the purpose for which it was designed when he stood on the top cap of the step ladder.

29 CFR  1926.20(b)(1):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about January 12, 2022, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, when an employee installed OSB sheathing to the second floor level of a new build residential home.  The employee was exposed to a fall hazard of approximately 13 feet from the unprotected side and edge of the framed wall to the gravel ground level as a result.  b.  On or about January 12, 2022, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, when an employee installed OSB sheathing to the second floor level of a new build residential home.  The employee was exposed to a fall hazard of 9 feet on top of the framed wall to the lower level.  c.  On or about January 12, 2022, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, when an employee installed OSB sheathing to the second floor level of a new build residential home.  The employee was exposed to a fall hazard of 9 feet and approximately 13 feet on top of the framed wall to the lower level.  d.  On or about January 12, 2022, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, when an employee stood on top of the step ladder to install OSB sheathing and not using the ladder for the purpose for which it was designed.  Angel JR Construction was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1488142, citation number 1, item number 1  and was affirmed as a final order on November 06, 2020, with respect to a workplace located at 235 Woodland Sky Drive, Lot 104, Pataskala, Ohio 43062.

29 CFR  1926.21(b)(2):  The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about January 12, 2022, the employer failed to instruct the employees on the avoidance of unsafe conditions, when an employee installed OSB sheathing to the second floor level of a new build residential home.  The employee was exposed to a fall hazard approximately 13 feet from the unprotected side and edge of the framed wall to the gravel ground level as a result.  b. 29 CFR  1926.501(b)(13):  "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about January 12, 2022, the employer failed to ensure that an employee was protected from falling when framing work was done on the second floor level for a new build residential home.  Employee #1 was exposed to a fall hazard at approximately 13 feet at the unprotected side and edge of the framed wall to the gravel ground level as a result.  b.  On or about January 12, 2022, the employer failed to ensure that an employee was protected from falling when framing work was done on the second floor level for a new build residential home.  Employee #2 was exposed to a fall hazard of 9 feet on top of the framed wall to the lower level as a result.  c.   On or about January 12, 2022, the employer failed to ensure that an employee was protected from falling when framing work was done on the second floor level for a new build residential home.  Employee #3 was exposed to a fall hazard of 9 feet at the interior to the lower level and approximately 13 feet on top of the framed wall to the gravel ground level.   Angel JR Construction was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1488142, citation number 1, item number 4 and was affirmed as a final order on November 06, 2020, with respect to a workplace located at  235 Woodland Sky Drive, Lot 104, Pataskala, Ohio 43062.
