29 CFR 1910.29(b)(2)(iv): The employer did not ensure that guardrails met the requirement that other equivalent intermediate members (such as additional midrails and architectural panels) that are installed so that the openings are not more than 19 inches (48 cm) wide. a) Bale Crusher: On or about January 12, 2022 and times prior employees were exposed to slip & falls into a bale crusher. The bale crusher was not adequately guarded in that there was a 29 inch opening between the bottom rail and the floor.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: a)Maintenance Shop DeWalt Grinder Right Side: On or about January 10, 2022 and times prior, an employee used a DeWalt 6 inch abrasive bench grinder to sharpen tools. The grinder did not have the adjustable tongue guard on the right side adequately adjusted resulting in a 1/2 inch opening between the abrasive wheel and the top of the grinder. a) Maintenance Shop DeWalt Grinder Left Side: On or about January 10, 2022 and times prior, an employee used a DeWalt 6 inch abrasive bench grinder to sharpen tools. The grinder did not have the adjustable tongue guard on the left side adequately adjusted resulting in a 1 inch opening between the abrasive wheel and the top of the grinder.
