29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a) On January 12, 2022; the competent person did not remove employees or take necessary precautions when employees were installing a new 8" sewer line in an excavation approximately 20' deep, with nearly vertical walls, visible fissuring, and Type C soil.  A partial cave-in of the east wall had occurred on the day of but prior to the inspection.  NOTE: Abatement certification and documentation are required for this item.

NOTE: Abatement certification AND documentation are required for this item.  Dahle Construction, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1260559, citation number 1, item number 1c, and was affirmed as a final order on 10/23/2017, with respect to a workplace located at Brookside Drive, Boise, ID 83713.
