OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from fall, crushing, and struck-by injuries:  a) On July 30, 2024, the bucket of a Caterpillar 315C excavator was used to carry a worker out of an approximate 6.5 to 7 feet deep excavation for a septic tank.

29 CFR  1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid:  a) On or about July 30, 2024, workers engaged in excavation and other construction activities were 21 minutes or more from a hospital and emergency response time, and did not have trained or qualified first aid responders with a valid certificate at the jobsite.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Employees used a Makita handheld rotary hammer drill to bore holes into approximate 6 inch thick concrete foundation for septic system connections.  The drill was not equipped any type of dust collection system.  No exposure determination had been made and no other measures were taken to control the concrete and respirable crystalline silica dust levels.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a) A ladder or other safe means of egress was not provided for a worker in an approximate 6.5 to 7 feet deep excavation with approximate vertical walls in wet and slippery soils.  Dahle Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1572382, citation number 1, item number 2a, and was affirmed as a final order on April 3, 2023, with respect to a workplace located at Starhaven and Hidden Lakes Drive in Star, ID.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) An employee was exposed to cave ins when working in an excavation approximately 6.5 to 7 feet deep with vertical walls.  The excavation was to place a septic tank and was estimated at approximately 8 feet wide by 15 feet long.  Dahle Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1572382, citation number 2, item number 1, and was affirmed as a final order on April 3, 2023, with respect to a workplace located at Starhaven and Hidden Lakes Drive in Star, ID.

29 CFR  1904.39(a)(1):  Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  a)  On July 30, 2024, the employer became aware of an employee death that occurred on a jobsite near Salmon, ID. Once the employer became aware that a fatality was work-related and not natural causes, the employer did not notify OSHA.
