29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) Restaurant: On or about January 12, 2022 to present, employees operated one of two Cookshack model FEC 750 Rotisserie Smokers located in a back room inside the restaurant. Employees are required to periodically add wood pellets into the machine as well as add, remove and check the meats and vegetables while they cooked. Employees may make necessary adjustments during the smoking process exposing them to Carbon Monoxide from wood smoke. Chemicals in wood smoke include Carbon monoxide, methane, benzene, formaldehyde, acetaldehyde, acrolein and polycyclic aromatic hydrocarbons (PAHs), and fine particles among others. The employer did not develop or implement a written hazard communication program which included all chemicals present in the facility.

29 CFR 1910.1200(g)(1): The employer did not have a safety data sheet in the workplace for each hazardous chemical which they use: a) Restaurant: On or about January 12, 2022 to present, employees operated one of two Cookshack model FEC 750 Rotisserie Smokers located in a back room inside the restaurant. Employees are required to periodically add wood pellets into the machine as well as add, remove and check the meat and vegetables while they cooked. The 100% hickory wood pellets are used in the smoker oven daily but the employer did not have the safety data sheet present in the facility.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Restaurant: On or about January 12, 2022 to present, employees operated one of two Cookshack model FEC 750 Rotisserie Smokers located in a back room inside the restaurant, adding wood pellets periodically. Employees are exposed to wood smoke and cook using natural gas on several ranges in the kitchen, but the employer did not provide the required Hazard Communication information to employees.
