OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to stuck-by and crush-by hazards:   a) Warehouse (Orange/Green Rack System): On or about January 11, 2022, and at times prior thereto the employer failed to anchor and bolt down storage racks to prevent employees from exposure to struck-by and/or crush hazards when working near storage racks. Additionally, the employer failed to ensure that a placard indicating the storage racks maximum loading capacity was conspicuously displayed on the racks to ensure the rack wouldn't become overloaded.

29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) Production  Yard Area (Mechanic Shop): On or about January 11, 2022, and times prior; the employer required employees to perform storage operations without fall protection on an elevated platform with an unprotected edge; exposing employees to fall hazards up to approximately ten feet (10') to the concrete floor below.  b) Production Yard Area (File Room): On or about January 11, 2022, and times prior; the employer required employees to perform shipping/receiving operations without fall protection on an elevated platform with an unprotected edge; exposing employees to fall hazards up to approximately fifteen feet (15') to the concrete ground below.  c) Warehouse Area (Grey Rack System): On or about January 11, 2022, and times prior; the employer required employees to perform rack storage operations without fall protection at the end of the second level storage area with an unprotected edge; exposing employees to fall hazards up to approximately seven feet (7') to the concrete floor below.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  a)  Planer Mill Area (In-Feed Area): On or about January 11, 2022, and at times prior, the employer failed to ensure employees utilized the hazardous energy control procedure when employees were engaged in servicing and maintenance activities, including but not limited to clearing lumber jams in and around the pressure and pineapple rolls at the infeed conveyor system; exposing employees to caught-in and struck-by hazards.  The Rex Lumber, Graceville LLC DBA (Doing Business As) Rex Lumber was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1910.147(c)(4)(i), which was contained in OSHA inspection number 1514664, citation number 1, item number 1 and was affirmed as a final order on March 29, 2022, with respect to a workplace located at 5299 Alabama Street Graceville, FL 32440.
