29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged: a) Shipping and Receiving - On or about December 13, 2021, powered industrial trucks were used to move loads that were not stable or safely arranged. The Kalmar AC, Inc, Model C100 CXPS, sit down forklift was used to lift and move material with the load suspended underneath the tines. The tines on the forklift were not rated to lift material with the load suspended underneath. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.178(q)(6): Powered industrial trucks were altered so that the relative positions of the various parts were different from what they were when originally received from the manufacturer, or altered by the addition of extra parts not provided by the manufacturer, or by the elimination of any parts without the manufacturer's approval: a) Shipping and Receiving - On or about December 13, 2021, the powered industrial truck was altered without the manufacturer's approval. Forks on the Kalmar AC, Inc, Model C100 CXPS, sit down forklift were used to lift material underneath the tines. A pin was attached to a hole in the tines of the forklift. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
