29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: On or about 1/14/2022 at the jobsite on the south side and east side of the southeast corner of the structure. Employees were observed climbing the cross braces and frames of the scaffold to access and egress from the second platform level, measured to be approximately 14.5 feet above the ground.

29 CFR 1926.451(e)(6)(i): Integral prefabricated scaffold access frames were not specifically designed or constructed for use as ladder rungs: On or about 1/14/2022 at the jobsite on the south side and east side of the southeast corner of the structure. Employees were observed climbing the frames of the scaffold to gain access to and egress from the second platform level, measured to be approximately 14.5 feet above the ground.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level. On or about 1/14/2022 at the jobsite on the south side, west side, and east side of the southeast corner of the structure, employees were working from second level scaffold platforms that were not guarded or were only partially guarded in the following instances: a & b) west side, two platforms no midrails; c & d) east side, two platforms no midrails; e & f) south side, center two platforms no midrails; g) south side, east end, one platform no guarding; h) east side, south end frame no guarding; and i) west side, south end frame no guarding.
