29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: On or about 2/10/2022 at the jobsite on the south and east corners of the structure, employees were observed climbing the frames of the scaffold to access and egress from the second and third platform levels, measured to be approximately 14 and 20 feet, respectively, above the ground.

29 CFR 1926.451(e)(6)(i): Integral prefabricated scaffold access frames were not specifically designed or constructed for use as ladder rungs: On or about 2/10/2022, at the jobsite on the south and east corners of the structure, employees were observed climbing the frames of the scaffold to access and egress from the second and third platform levels, measured to be approximately 14 and 20 feet, respectively, above the ground.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level. On or about 2/10/2022 at the jobsite on the south and east corners of the structure, employees working from the scaffold system were exposed to the hazard of falling from the scaffolds in the following instances: a-g) third level, 7 unguarded platforms; h-j) second level, east side, 3 platforms--no midrails; k-l) second level, east side, 2 end frames--no guarding; m-o) second level, south side, 3 platforms--no midrails; p) second level, west end of south side--no guarding; q) second level, south side, west end crossover platform--no guarding.
