29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Front side of Unit #102: On or about 01/31/2022, the employer exposed an employee to struck-by hazards from overhead roof sheathing work, in that protective helmet was not provided to an employee working directly below the sheathing installation work while working in a Genie  S-85XC Aerial Lift/MEWP installing sheathing.

29 CFR  1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:   a) New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Front side of Unit #102: On or about 01/31/2022, the employer exposed an employee to ejection/fall hazards of over 35-ft. from the lower ground level, in that a fall arrest system was not attached to the anchor point provided in the aerial lift basket while engaged in framing activities.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Unit #102 Roof: On or about 01/31/2022, the employer exposed an employee to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided while engaged in plywood sheathing installation activities operating these tools at 150 PSI.   3 Hermanos Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1531751, citation number 1, item number 1 and was affirmed as a final order on 11/02/2021, with respect to a workplace located at Halcyon Subdivision, 6455 Halcyon Garden Drive Building #20, Alpharetta, GA 30004.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Unit #102 Roof: On or about 01/31/2022, the employer exposed an employee to fall hazards of approximately 24-feet, 7-inches to the lower level, in that a fall protection system was not provided to employees engaged in plywood sheathing activities on a 4/12 and 11/12 pitched roof.   b) New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Unit #96 Roof: On or about 01/31/2022, the employer exposed an employee to fall hazards of approximately 24-feet, 7-inches to the lower level, in that a fall protection system was not provided to employees engaged in plywood sheathing activities on a 4/12 pitched roof.  c)  New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Unit #99 Second level top plate: On or about 01/31/2022, the employer exposed an employee to fall hazards of approximately 24-feet, 7-inches to the lower level, in that a fall protection system was not provided to employees engaged in roof truss activities from the top plate.  3 Hermanos Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1531751, citation number 1, item number 2 and was affirmed as a final order on 11/02/2021, with respect to a workplace located at Halcyon Subdivision, 6455 Halcyon Garden Drive Building #20, Alpharetta, GA 30004.

29 CFR  1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:   a) New townhome construction located on Lots #96-104 Atley Place, Alpharetta, GA 30009, Front side of Unit #99: On or about 01/31/2022, the employer failed to inspect all electrical extension cords used to provide power to the Makita 5007F 7-1/4-inch Circular Saws plugged into the three way power cord which had a damaged outer casing exposing the internal insulated wires. An inspection of these cords were not performed prior to the shift as these cords were not repaired or removed from service.
