29 CFR 1910.28(b)(3)(v)(A): The employer did not ensure that each employee was protected from falling through a hatchway by a hinged floor-hole cover that meets the criteria in � 1910.29 and a fixed guardrail system that leaves only one exposed side. a) On or about 1/30/2022, Employees opened a hatch cover on silo #7. The hatch was at the walking elevation and the employer did not ensure there were railings or grating to prevent employees from falling through the opening. Employees were exposed to falls of approximately 12 feet to the product below. Abatement documentation is required for this item.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: a) On or about 1/24/22; The employer required employees to enter Batch House #2 Check Scale to perform maintenance activities such as cleaning the scale. This space was a permit required confined space and employees entered the space without the employer implementing a Permit Required Confined Space Program. Measures required to be implemented, as specified in paragraph (d) of the standard, include but are not limited to, identifying, and evaluating the hazards of the permit space prior to entry, isolating the permit space, evaluating atmospheric hazards, providing equipment needed for safe access and egress, entry and rescue. Abatement documentation is required for this item.
