29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking/working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) RV Repair Bay: On or about January 31, 2022 and times prior, thereto the employer exposed employees to fall hazards of 10 feet 9 inches to the lower level. The employer did not ensure that the employees walking/working on top of 5th wheel recreational trailer were protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems. b) RV Repair Bay: On or about January 31, 2022 and times prior, thereto the employer exposed employees to fall hazards of 9 feet 5 inches to the lower level. The employer did not ensure that the employees walking/working on top of travel recreational trailer were protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Servicing Department: On or about January 31 2022 and at times prior thereto the employer exposed employees to struck-by and crushed-by hazards in that employees were allowed to operate a Doosan 30 forklift with a homemade 5th Wheel / Receiver Hitch Attachment, identified as the Magic Mover. The forklift attachment was not certified by the manufacturer of the forklift or an approved engineer, and did not have updated instruction plates, tags, or decals. b) Servicing Department: On or about January 31 2022 and at times prior thereto the employer exposed employees to struck-by and crushed-by hazards in that employees were allowed to operate a Doosan 25 forklift with a homemade 5th Wheel / Receiver Hitch Attachment, identified as the Magic Mover.
