29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a) On or about February 24. 2022 the employer did not obtain the manufacturers prior written approval and did not update the instruction plates, tags or decals when the Wesco Gator Grip, Model number 240091, used to move drums of chemicals was attached to the Rico sit-down forklift # 49.

29 CFR 1910.178(a)(6):The user shall see that all nameplates and markings are in place and are maintained in a legible condition. a) On or about February 24, 2022 the nameplate and markings on forklifts such as but not limited to the Rico sit-down forklift # 49 were not maintained in legible condition in that operators could not read what the load center would be for the 42 inch forks and attachments.

29 CFR 1910.178(l)(4)(ii)(E): Refresher training in relevant topics shall be provided to the operator when: A condition in the workplace changes in a manner that could affect safe operation of the truck. a) On or about December 29, 2021 the employers refresher training was in adequate in that it did not cover the narrowed aisleways and change in path of travel caused by the increase in storage of various chemicals located in front of the Fire Tech room that resulted in a forklift accident where a forklift operator punctured a 55 gallon drum of R-49-05-15.
