29 CFR 1910.106(d)(5)(v): "General purpose public warehouses." Storage shall be in accordance with Table H-14 or H-15 and in buildings or in portions of such buildings cut off by standard firewalls. Material creating no fire exposure hazard to the flammable liquids may be stored in the same area. On or about February 24, 2022, flammable liquids were stored in an unprotected storage not in accordance with Table H-14 or H-15 in that: a. The Acrolon 218 HS Polyurethane Semi-Gloss (Part A) Ultradeep Clear Tint Base, (7) 320-gallon totes of Category 2 flammable liquid totaling 2,240 gallons; and the Hi-Solids Polyurethane 250 Semi-Gloss (Part S) Ultradeep Base, (19) 55-gallon drums, (1) partial 55-gallon drum containing 15-gallons, and (2) 5-gallon pails of Category 2 and 3 flammable liquid totaling 1,070 gallons was stored at Column G13/F13. b. The Polyester Resin Solution and Acrylic Resin, (145) 55-gallon drums of Category 3 flammable liquid totaling 7,975 gallons was stored at Column G5/F5. c. The Polyester Resin Solution and Acrylic Resin, (52) 55-gallon drums of Category 3 flammable liquid totaling 2,860 gallons was stored at Column G7. d. The Acrolon 218 HS Polyurethane Gloss (Part A) Ultradeep Clear Tint Base, (4) 300-gallon totes and (18) partial 300-gallon totes of Category 2 flammable liquid totaling 1,200+ gallons was stored at Columns M6/M7. e. The Reclaim Solvent, (16) 55-gallon drums of Category 2 flammable liquid totaling 880 gallons; the Suspenso 201-X, (9) 55-gallon drums of Category 3 flammable liquid totaling 495-gallons; the Solvent Methyl Ethyl Ketone, (2) partial 275-gallon totes of Category 2 flammable liquid; and Styrene Monomer, (9) partial 275-gallon totes of Category 3 flammable liquid was stored at Columns A2/B3. f. The Acetone, (40) 55-gallon drums of Category 2 flammable liquid totaling 2,200 gallons; the Xylene, (16) 55-gallon drums of Category 3 flammable liquid totaling 880 gallons; and the Derakane, (15) 55-gallon drums of Category 3 flammable liquid totaling 825 gallons was stored in the Receiving Storage area.

On or about February 24, 2022, the employer did not ensure that the storage of flammable liquids in containers such as but not limited to 5-gallon pails, 55-gallon drums, 275-gallon totes, 300-gallon totes, and 320-gallon totes were stored in accordance with paragraph d.

29 CFR 1910.106(d)(4)(i): "Construction." Inside storage rooms shall be constructed to meet the required fire-resistive rating for their use. Such construction shall comply with the test specifications set forth in Standard Methods of Fire Tests of Building Construction and Materials, NFPA 251-1969. Where an automatic sprinkler system is provided, the system shall be designed and installed in an acceptable manner. Openings to other rooms or buildings shall be provided with noncombustible liquid-tight raised sills or ramps at least 4 inches in height, or the floor in the storage area shall be at least 4 inches below the surrounding floor. Openings shall be provided with approved self-closing fire doors. The room shall be liquid-tight where the walls join the floor. A permissible alternate to the sill or ramp is an open-grated trench inside of the room which drains to a safe location. Where other portions of the building or other properties are exposed, windows shall be protected as set forth in the Standard for Fire Doors and Windows, NFPA No. 80-1968, which is incorporated by reference as specified in Sec. 1910.6, for Class E or F openings. Wood at least 1 inch nominal thickness may be used for shelving, racks, dunnage, scuffboards, floor overlay, and similar installations. a.) On or about February 24, 2022, areas such as but not limited to the C1D1 mixing room was not adequately constructed as an indoor storage room with at least 4 inch sills or ramps.
