29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) New residential construction located on Lot #177 at 601 Skye Court, Peachtree City, GA 30269, Stairwell located between first and second levels: On or about 02/02/20222, the employer exposed employees to falls up to 10-feet, 4-inches to the lower level, in that a ladder with side rails extended at least 3-feet past the second floor landing was not provided to allow safe access to each level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located on Lot #177 at 601 Skye Court, Peachtree City, GA 30269, Roof: On or about 02/02/2022, the employer exposed employees to falls up to 20-feet, 5-inches to the lower ground level, in that a complete fall protection system was not provided to an employee installing plywood sheathing on a 7/12 pitched roof. Sergio Estuardo Ramos was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1326559, citation number 1, item number 2 and was affirmed as a final order on 08/10/2018, with respect to a workplace located at The Overlook at Old Atlanta Subdivision, Lot #27, Suwanee, GA 30024.
