29 CFR 1910.106(e)(6)(ii):Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with: (a)Dakota Foundry, Inc. dba Dakota Foundry at 20 Park Lane Webster, SD 57274: On or about and at times prior to February 2, 2022, the employer did not ensure employees were protected from fire hazards in that a 55-gallon steel drum of a release agent containing approximately 40% isopropyl alcohol and 60% release agent paint was not appropriately grounded. This condition exposed employees to fire hazards. (b)Dakota Foundry, Inc. dba Dakota Foundry at 20 Park Lane Webster, SD 57274: On or about and at times prior to February 2, 2022, the employer did not ensure employee were protected from fire hazards in that a outdoor storage tank containing isopropyl alcohol (99%) was not appropriately grounded. This condition exposed employees to fire hazards.

This condition exposed employees to amputation and caught-in hazards associated with the unguarded auger.
