29 CFR 1926.760(b)(3): Be provided, at heights over 15 and up to 30 feet above a lower level, with a personal fall arrest system, positioning device system or fall restraint system and wear the equipment necessary to be able to be tied off; or be provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section. On or about February 08, 2022, on a commercial building under construction, an employee was conducting roofing activities without a fall protection system at a height exceeding 16 feet. Scorpion Metal Erectors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.760(b)(3), which was contained in OSHA Inspection number 1548266, citation number 1, item number 2 and was affirmed as a final order on 11/09/2021, with respect to a workplace located at 1024 Kitty Hawk Road, SAN ANTONIO, TX 78248.
