29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least: On or about February 7, 2022, and at time prior thereto, employees used compressed oxygen and fuel gas cylinders to cut, repair and replace dump trucks parts and other structures. The employer did not ensure that the compressed gas cylinders were separated when not in use. This exposed employees to fire and struck-by hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about February 7, 2022, and at time prior thereto, the employer had not maintained and implemented the Hazard Communication program, which would address labeling, and other forms of warning on chemicals containers, Safety Data Sheets and employees' information and training on the hazards associated with chemicals used at this site. Employees were involved in repairing and maintaining dump trucks metal and plastic parts or when those parts are paint sprayed, lubricated and cleaned were exposed to hazardous chemicals and materials.
