29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder;  1856 Fabian Way, Austell, GA 30106 (lot 28 - 31): On or about February 8, 2022 and at times prior, employees engaged in roofing activities (shingle installation) were exposed to fall hazards while accessing/egressing the upper level (roof). The upper level was at a height at or above 21 feet to the lower (ground) level.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels were not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  1856 Fabian Way, Austell, GA 30106: On or about February 8, 2022 and at times prior, the employer exposed employees to fall hazards, in that fall protection (fall arrest system, guardrails system, safety net system) was not provided to all employees while performing shingle installation on the roof on lots 28 - 31.  Elite Pro Roofing LLC was previously cited as Naftali Espinola Rodriguez for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1480481, citation number 1, item number 1 and was affirmed as a final order on August 11, 2020, with respect to a workplace located at Lot #5 at 230 Jennah Walk, Union City, GA 302912.
