29 CFR 1926.304(d):Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: New townhome construction located on Lots #126 and #127 Toccata Lane, Marietta, GA 30067, Front side of unit #126: On or about 02/02/2022, the employer exposed employees to severe laceration and amputation hazards, in that employees operated a circular saw with the lower guard not operable as a shim was placed between the guards while cutting Gold Bond eXP Shaftliner fire barrier wall sheathing. A shim was used to keep the lower guard from retracting after a cut was made.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: New townhome construction located on Lot #127 at 1825 Toccata Lane, Marietta, GA 30067, First level at stairwell: On or about 02/02/2022, the employer exposed employees to fall hazards of approximately 8-feet to the lower concrete surface below, in that a ladder extended at least 3-feet past the landing was not provided to allow safe access to each level. Employees accessed a 6-ft. step ladder to access a height of 8-feet to the next level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New townhome construction located on Lot #127 at 1825 Toccata Lane, Marietta, GA 30067, 3rd Level: On or about 02/02/2022, the employer exposed employees to fall hazards of over 21-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities using the third level as a walking/working surface. b) New townhome construction located on Lot #126 at 1821 Toccata Lane, Marietta, GA 30067, 3rd Level: On or about 02/02/2022, the employer exposed employees to fall hazards of over 21-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities using the third level as a walking/working surface. Medrano Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1258399, citation number 1, item number 4 and was affirmed as a final order on 01/11/2018, with respect to a workplace located at 431 Meadow Lake Terrace, Braselton, GA.
