29 CFR  1926.304(d):Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  New townhome construction located on Lots #126 and #127 Toccata Lane, Marietta, GA 30067, Front side of unit #126: On or about 02/02/2022, the employer exposed employees to severe laceration and amputation hazards, in that employees operated a circular saw with the lower guard not operable as a shim was placed between the guards while cutting Gold Bond eXP Shaftliner fire barrier wall sheathing. A shim was used to keep the lower guard from retracting after a cut was made.

Medrano Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1258399, citation number 1, item number 4 and was affirmed as a final order on 01/11/2018, with respect to a workplace located at 431 Meadow Lake Terrace, Braselton, GA.
