The employer failed to protect employees from fall hazards when conducting framing operations on a residential structure while working from elevated mobile scaffolding. This was most recently documented on or about February 18, 2022 at a residential construction jobsite located at 18110 Northern Hills Dr., Bennington Nebraska. The exposed employees were not utilizing any form of fall protection when working from the elevated mobile scaffolding that was not fully guarded at a height greater than 16 feet.

The exposed employees were accessing an unprotected level of the residential structure that was at a height of over 6 feet and not utilizing any form of fall protection. XM Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1523752, citation number 1, item number 1 and was affirmed as a final order on July 6, 2021, with respect to a workplace located at 3905 N 187th Ave., Elkhorn Nebraska.
