(b)The employer failed to certify that Citation 1, Item 2, issued on 06/02/2022 with an abatement date of 07/21/22 had been abated.  (c)The employer failed to certify and provide documentation that Citation 2, Item 1, issued on 06/02/2022 with an abatement date of 06/29/22 had been abated.

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  The employer failed to protect employees from fall hazards when conducting framing operations on a residential structure while working from elevated mobile scaffolding. This was most recently documented on or about February 18, 2022 at a residential construction jobsite located at 18110 Northern Hills Dr., Bennington Nebraska. The exposed employees were not utilizing any form of fall protection when working from the elevated mobile scaffolding that was not fully guarded at a height greater than 16 feet.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:  The employer failed to protect employees from fall hazards associated with using ladders during residential construction work. This was most recently documented on or about February 18, 2022 at a residential construction jobsite located at 18110 Northern Hills Dr., Bennington Nebraska. The employer failed to ensure that each employee is trained to recognize the hazards associated with working with ladders.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  The employer failed to protect employees from fall hazards when conducting framing operations on a residential structure. This was most recently documented on or about February 18, 2022 at a residential construction jobsite located at 18110 Northern Hills Dr., Bennington Nebraska. The exposed employees were accessing an unprotected level of the residential structure that was at a height of over 6 feet and not utilizing any form of fall protection.  XM Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1523752, citation number 1, item number 1 and was affirmed as a final order on July 6, 2021, with respect to a workplace located at 3905 N 187th Ave., Elkhorn Nebraska.
