29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system. Employees were engaged in framing activities at a new construction residential building located at 2305 182nd St., Elkhorn, NE 68022, and were exposed to fall hazards in that the employees were working in excess of 6-feet while conducting residential framing operations without any form of conventional fall protection such as but not limited to; guardrail systems, safety net system, or personal fall arrest system. The XM Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1523752, citation number 1, item number 1 and was affirmed as a final order on 07-06-2021, with respect to a workplace located at 3905 N 187th Ave., Elkhorn, NE 68022. The XM Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1579236, citation number 2, item number 1 and was affirmed as a final order on 06-29-2022, with respect to a workplace located at 18110 Northern Hills Dr., Bennington, Nebraska 68007.

Employees were engaged in framing activities at a new construction residential building located at 2305 182nd St., Elkhorn, NE 68022, and were exposed to fall hazards in that the employees were being elevated to and from the roof with a powered industrial truck mounted scaffold that was not secured to the lifting carriage and/or forks while conducting residential framing operations.
