OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to struck-by and crushing hazards: On or about 2/09/2022, the employer failed to ensure that workers stayed clear of any/all unsecured loads. While in the process of loading 35 feet fiberglass streetlight/lamp poles onto a flatbed, an employee was knocked off/fell from the flatbed of a semi- trailer truck. The employee was subsequently hospitalized because of the injuries sustained from the fall.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about 2/09/2022, an employee was exposed to fall of approximately 4' feet, 4.5" inches, while working from the top of a flatbed trailer during the loading of 35 feet fiberglass streetlight/lamp poles without any method of fall protection. The employee was hospitalized after being knocked off/from the flatbed trailer when the load shifted and rolled.

29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about February 09, 2022, untrained employees were allowed to operate powered industrial vehicles (e.g.: the company's forklift) at the site without having received formal instruction, including operator evaluation to determine the retention of the information. While in the process of loading fiberglass street poles that measured 6 inches in diameter and tapered to 2 inches at the top and approximately 35 ft. in length, an employee attempting to aiding in the loading of the streetlight poles was injured when he was knocked off trailer. A second employee who was tasked with operating the fork truck, was in the process of unloading the poles as he backed-up he raised the forks causing the tiered bundle of poles roll. Both employees were untrained.
