29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) On or about June 04, 2025, the employer did not ensure that employees working inside a trench in excess of 5 feet in depth with nearly vertical walls were protected from cave-in hazards. The employer did not utilize a protective system to protect employees in the trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) On or about June 04, 2025, the employer did not ensure that daily inspections of the excavation and the adjacent area were made by a competent person for evidence of a situation that could have resulted in a hazardous condition. Employees were working in the excavation without a protective system. The competent person failed to identify through inspections the need for appropriate protective systems to be placed within the trench. This condition exposed employees to crushing hazards by excavation wall cave-in.
